Terms & Conditions (AGB)

(1) These General Terms and Conditions ("GTC") apply to all contracts concluded between TDF Labs GmbH ("we", "us") and the customer through the PeachMe Sports online shop at peachme.sports.

(2) A consumer within the meaning of these GTC is any natural person acting for purposes outside their trade, business or profession (§ 13 BGB). An entrepreneur is any natural or legal person acting in the exercise of their commercial or independent professional activity (§ 14 BGB).

(3) The contract language is German. Where this document is also provided in English, the German version prevails in case of inconsistency.

(4) Conflicting or supplementary terms of the customer become part of the contract only with our express written consent.

(1) The presentation of products in our online shop is not a legally binding offer but an invitation to submit an offer.

(2) By clicking the "Zahlungspflichtig bestellen" button at the end of the checkout process, you place a binding offer to purchase the items in your shopping cart.

(3) An automatic acknowledgement of receipt is sent immediately after order submission. This acknowledgement does not constitute acceptance of your offer. The contract is concluded when we accept your offer by sending a separate order confirmation by email or by dispatching the goods, whichever occurs first.

(4) Before submitting the order, you can correct your entries at any time. The contract text is saved by us and can be requested by email.

(1) All prices stated in our shop are total prices in Euro including the statutory German value-added tax (currently 19%). Shipping costs, if any, are shown separately before the order is finalised.

(2) The total amount including shipping is displayed before the "Zahlungspflichtig bestellen" button. No additional fees or charges are added beyond those stated.

(3) Payment is due immediately upon order placement. We accept the payment methods displayed at checkout (currently credit/debit card, Apple Pay, and Google Pay), processed via Stripe Payments Europe, Ltd. (Ireland).

(4) In the event of payment default, statutory default interest applies (§ 288 BGB). We reserve the right to claim further damages caused by default.

(1) Delivery is currently only within Germany. International delivery is not offered at this time.

(2) Goods are typically dispatched within 2 business days of order acceptance and delivered by DHL Paket GoGreen within a further 3–5 business days. Delivery times are non-binding unless expressly agreed in writing.

(3) The risk of accidental loss or deterioration of the goods passes to the consumer upon delivery; for business customers, it passes upon handover to the carrier (§ 447 BGB).

(4) If a product becomes permanently unavailable after order acceptance through no fault of our own, we will inform you without undue delay and refund any payments already made. Further claims are excluded in this case.

(5) Partial deliveries are permitted to the extent reasonable for the customer; no additional shipping costs arise from partial deliveries.

Consumers have a statutory 14-day right of withdrawal. Detailed information including the model withdrawal form is available on our Widerrufsbelehrung page (/legal/widerruf) and is provided again in the order confirmation email. The statutory exceptions under § 312g (2) BGB do not apply to our products.

(1) Statutory warranty rights apply. For new goods sold to consumers, the warranty period is 24 months from delivery (§ 438 (1) no. 3 BGB). For used goods, the period is 12 months. For business customers, the warranty period is 12 months from delivery.

(2) Customers are requested to report obvious defects promptly so that we can resolve them efficiently. This request is voluntary for consumers and has no impact on statutory warranty rights.

(3) To exercise warranty rights, please contact us at [email protected] with your order number and a description of the defect. We will provide instructions for return or repair. No separate commercial guarantee is granted beyond the statutory warranty.

(1) We are liable without limitation only for damages arising from injury to life, body or health, for damages caused by intent or gross negligence, and under the German Product Liability Act (ProdHaftG). These liabilities cannot be excluded under German law.

(2) For simple negligence, our liability is limited to the foreseeable damages typical for a contract of this kind and arises only from the breach of a material contractual obligation (Kardinalpflicht), i.e. an obligation whose fulfilment is essential for the proper execution of the contract and on whose observance the customer regularly relies. The amount of such liability is capped at the gross value of the order concerned. Liability for indirect damages, loss of profit, loss of data, or other consequential damages is excluded. The monetary cap in this paragraph does not apply to the unlimited categories of liability under paragraph (1).

(3) The above limitations apply equally to our employees, representatives, and vicarious agents.

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers domiciled in the European Union, mandatory consumer-protection provisions of the consumer's country of residence remain unaffected.

(2) For merchants, legal persons under public law and special funds under public law, Munich is the exclusive place of jurisdiction for all disputes arising from this contract. We are also entitled to sue at the customer's general place of jurisdiction.

(3) Should any provision of these GTC be invalid, the remaining provisions remain unaffected.
